    DG the thing that upsets me is that often people like this only see the inside of jail for a crime like this for a few months instead of the years they should have to pay. Especially there is a corelation to abusing and torturing animals and those that kill people.

    Here is Louisiana’s animal cruelty law:

    § 102.1. Cruelty to animals; simple and aggravated

    ********

    B. (1) Any person who intentionally or with criminal negligence tortures, maims, or mutilates any living animal, whether belonging to himself or another, shall be guilty of aggravated cruelty to animals.

    (2) N/A

    (3) N/A

    (4) Any person who intentionally or with criminal negligence mistreats any living animal whether belonging to himself or another by any act or omission which causes or permits unnecessary or unjustifiable physical pain, suffering, or death to the animal shall also be guilty of aggravated cruelty to animals.

    (5) In addition to any other penalty imposed for a violation of this Subsection, the offender shall be ordered to undergo a psychological evaluation and subsequently recommended psychological treatment and shall be banned by court order from owning or keeping animals for a period of time deemed appropriate by the court. Any costs associated with any evaluation or treatment ordered by the court shall be borne by the defendant.

    (6) Whoever commits the crime of aggravated cruelty to animals shall be fined not less than five thousand dollars nor more than twenty-five thousand dollars or imprisoned, with or without hard labor, for not less than one year nor more than ten years, or both.

    Dee, the minimum fine is $5,000 and the minimum length of imprisonment is one year.

    It is interesting to see that Louisiana’s statute provides for a psychological examination and bans the defendant from owning any animal for some length of time.

    SM I agree…it’s people like this that just make me want to vomit. How could you ever hurt an animal no matter what they do? I hope this creep doesn’t get out on only 5,000!! He deserves to be in jail and do manual labor like picking up manure with his bare hands

    The way I read the statute, the minimum fine that must be imposed is $5,000. The minimum amount of time he will be imprisoned is one year. It can go up from there on both the fine and the amount of time he will serve.

    Every time I see the pic of that poor beaten dog I want to take a baseball bat to Ralph Topey…and a sword…just like he did to the dog for pooping in the living room. Isn’t it weird that I abhor violence but I feel like I could beat the hell out of people who do this to animals and children?

    Both of them can be imposed. Both a fine and imprisonment. But you are right, the judge can choose to impose a fine only, imprisonment only or both.
